Q: Why do I need an attorney when Social Security told me that I did not?
A: While it is true that having a Social Security attorney is not an absolute requirement for successfully filing a claim, it is still a good idea to work with one if possible. Because most Social Security Disability claims are denied when you apply for the first time, having a lawyer on your side does not make much difference on first application. If you are denied, however, a lawyer can be vastly helpful.
After a claim is denied, you will generally need to file an appeal, where it will have a greater chance of success than in initial application. As part of the appeals process, your claim will be evaluated by an Administrative Law judge, and it is his or her job to decide whether or not you should be approved. It is during this part of the process that working with an attorney is key. Because while an attorney cannot guarantee that your claim will be approved, using one can have a real effect on your chances of approval.
Why are lawyers such a help? Because the truth is, most SS applicants do not have a thorough understanding of the Social Security process, and how to prepare their case. A social security attorney, on the other hand, knows how best to present your case in a hearing for the best chance of approval. Simply put, a SSD lawyer has the professional know how that you do not. A lawyer can assure that your case has been properly developed before you ever go into a hearing.
Q: Can I keep my job and work while applying for Social Security benefits?
A: A successful Social Security Disability claimant must prove that he or she cannot do the same work they used to, nor any new work which will earn them a gainful income. But this does not always mean that applicants cannot work while applying for social security benefits. It simply depends on how much work you do.
When you apply for SSD benefits, the Social Security Administration will ask you about any current employment. If you are currently working, the first thing the Social Security Administration will look at is your income. If you are making more than $830 a month (this number is for 2005 and is subject to change), your claim will automatically be denied. If, however, you make less than this amount, your claim may pass on to the next step in the application process.
Q: Are there any organizations out there that will help me to pay my rent and other bills while I'm applying for social security benefits?
A: Unfortunately, the Social Security Disability applications process is a slow and painful one. If you find yourself in need of financial or medical assistance while you wait for your benefits to begin, there are several different organizations that may be able to help. Your local community may have help centers or other organizations set up to help SSD applicants. Nationwide, there are other groups, like Saint Vincent de Paul, for instance, that work to provide financial help (including rent/mortgage payments, etc.) for the needy.

Note- Lawyers and their staff make mistakes, they are human beings. If you hire a lawyer make sure you stay on top of the case, step by step, don't put 100% of your trust in another human being in such an important matter.
My husband and I went through this process, it wasn't until we fired the lawyer and took the appeals into our own hands that we made some headway. Our lawyer-who was recommended- made some gross errors in timing with the appeals, you have to be your own advocate!
I need to appeal my VA disability and soon. And I have scoliosis of neck and back and I injured right foot in army I didnt know I could file a claim after i got out so after seeing a chiropractor that was in military told me i could file a claim.I filed a claim in nov 16 2009 and denied apr12 2011.They said they could not find my service medical records.I need to appeal who can help?
